Viewers Respond On Facebook To Geisinger's No-Tobacco Policy

Geisinger Health System, one of our area's largest employers, says starting February 1st, it will no longer hire people who use tobacco products, including cigarettes, cigars and chewing or smokeless tobacco.

Within moments of the announcement being posted on WNEP's Facebook page,the online social site exploded with responses, topping over 700 comments.

Some were outraged; Katie posted "What a great way in keeping that nine percent unemployment rate rolling hooah!".

Stephanie wrote "What right does anyone have to tell me where I can smoke once I'm off the clock?".

Many called this flat out discrimination, however Geisinger says this policy is legal in 20 states, including Pennsylvania and is not discriminatory.

Attorney Mark Powell, who deals in labor and employment law, says it's all about what's protected by law.

"There's no federal protection for smokers," said Powell. "We have federal employee rights against discrimination but smoking is not a protected class."

Geisinger's current policy bans smoking on its properties and says this further step is to promote a healthier lifestyle.

Applicants to Geisinger will be tested for nicotine, however those who fail are welcome to re-apply in six months as long as they are nicotine free.

Joel Stephenson works for Community Medical Center in Scranton, which is under going a merger with Geisinger.

He's a smoker but understands what Geisinger is doing.

"Since we're trying to take care of all the patients, then the doctors should be able to take care of themselves, even the nurses and everything," said Stephenson.

(AP) ? Vietnam may block its citizens from using Facebook, but that didn't stop website founder Mark Zuckerberg from vacationing in the communist country.

Zuckerberg spent Christmas Eve in the popular tourist destination Ha Long Bay, local official Trinh Dang Thanh says.

State-run media say Zuckerberg arrived in Vietnam on Dec. 22.

Zuckerberg spent Christmas Day at an ecolodge in the northern mountain town of Sapa and rode a buffalo, said Le Phuc Thien, deputy manager at Topas Ecolodge.

Zuckerberg, Facebook's 27-year-old CEO, founded the social networking site in 2004.

Vietnam's aggressive Internet censors block access to Facebook and other websites, but young Vietnamese easily bypass the restrictions.

Canada loses NHLer Devante Smith-Pelly to foot injury at world juniors

EDMONTON - Canada's team at the world junior hockey championship suffered a major blow in its tournament opener.

Forward Devante Smith-Pelly broke his left foot after blocking a shot in the second period of Canada's 8-1 rout of Finland on Monday and will miss the remainder of the tournament.

"Heartbreaking way to end my tournament, but I know the guys will do the country proud regardless. Thank you everyone for your kind words," said Smith-Pelly on his Twitter page.

The Anaheim Ducks forward, one of only two NHL players on the Canadian team, cannot be replaced on the 22-man roster.

The only situation in which a team could add another player at this point in the tournament would be in the case of a goaltender injury.

The six-foot, 207-pound Toronto native scored twice Thursday in Canada's 7-1 pre-tournament win over Switzerland 7-1.

The Ducks drafted Smith-Pelly in the second round, 42nd overall, and has contributed three goals and two assists in 26 games with Anaheim this season.

"This is a very unfortunate injury for Devante," said Ducks general manager Bob Murray in a statement. "We anticipated him playing a prominent role for Canada at the 2012 world junior tournament. Although this is a big loss for Canada and the Anaheim Ducks, we fully expect Devante to return to full health this season."

Hockey Canada says Smith-Pelly will remain with the Canadian junior team.

(AP) ? Drew Brees closed in on the single-season record for yards passing with 230 in one half, and he completed a pair of touchdown passes to lift the New Orleans Saints to a 21-10 halftime lead over the Atlanta Falcons on Monday night.

Brees entered the third quarter needing 75 yards to break Dan Marino's 1984 record of 5,084 yards. His two touchdowns gave him 274 for his career, moving him one ahead of Joe Montana for 10th all-time. He is the first quarterback in NFL history to pass for over 5,000 yards twice ? he had 5,069 in 2008.

His first scoring pass went for 8 yards to Marques Colston and the second for 9 yards to Jimmy Graham. Graham's TD catch was his 10th of the season, a new franchise high for a tight end.

The Saints also had 306 total yards in the opening half, giving them 6,700 offensive yards for the season, breaking the 2008 club record of 6,571 yards. New Orleans continues to close in on the NFL-record 7,075 offensive yards in a season set by the 2000 St. Louis Rams.

Matt Ryan passed for 159 yards and one TD, a 21-yard scoring strike to Julio Jones that gave the Falcons a 10-7 lead late in the first quarter.

New Orleans responded with a 10-play, 81-yard scoring drive on which Brees completed four of six passes for 48 yards, the last three to Colston, who had six catches for 69 yards in the first half.

The Saints might have led by more if Brees' pass intended for Graham in the end zone had not been broken up by linebacker Curtis Lofton, and then batted in the air by safety William Moore before coming to rest in the arms of Dominique Franks for an interception.

New Orleans bounced back on its final drive of the second quarter, covering 80 yards in 10 plays and only 1:55, capped by the Graham's TD catch.

Both teams scored on all of their possessions in the opening quarter, with the Saints briefly pulling in front 7-3 on Pierre Thomas' 4-yard touchdown run, after which he pulled a bow from his uniform pants, put it on the football and offered it as a gift to a woman with a parasol in the front row behind the end zone.

The referees weren't cutting Thomas any slack on his Christmas-themed celebration, flagging him for a 15-yard unsportsmanlike conduct penalty.

The score capped an eight-play, 84-yard scoring drive on which Brees completed two passes for 49 yards.

The Saints entered the game needing only one victory to clinch the NFC South title, while Atlanta could remain in the hunt to defend its 2010 division crown with a win.

After Atlanta received the opening kickoff, Ryan completed five of his first six throws for 52 yards, including a 20-yard completion to Roddy White at the New Orleans 23. The Saints' defense stiffened there, however, forcing Atlanta to settle for Matt Bryant's 34-yard field goal and an early 3-0 lead.

The Saints responded immediately, with Brees hitting Lance Moore for a 38-yard gain on New Orleans' first play from scrimmage. The Saints then went to the running game, with Chris Ivory rushing one time for 11 yards and Thomas three times for 24 yards, including his short TD run.

Thomas' unsportsmanlike conduct penalty, enforced on the ensuing kickoff, was not terribly costly, as Eric Weems returned it to the Atlanta 28. More costly was the Saints' inability to slow down Ryan, who quickly found Jones for a 25-yard gain and White for 16 yards to set up the scoring pass to Jones.

Special Holiday Visit For Canadian Troops

OTTAWA - Canadians stationed overseas received a special visit over Christmas.

The governor general spent the holidays visiting Canadian soldiers and civilians in Italy and Afghanistan.

"The sacrifice of troops and civilians who are away from their families and friends at this time of the year is tremendous and I wish them the best of luck in the completion of their missions," David Johnston said in a statement.

He was joined on the trip by Defence Minister Peter MacKay and General Walt Natynczyk, chief of the defence staff.

Johnston had already been overseas for the state funeral of former Czech president Vaclav Havel, who died earlier this month.

Prior to the funeral, he, MacKay and Naynczyk visited with Canadian military personnel in Italy.

The approximately 250 sailors and air crew of the HMCS Vancouver joined a NATO counter-terrorism effort in the Mediterranean in November, after being deployed as part of the international mission in Libya.

Afterwards, the three men travelled to Afghanistan to celebrate Christmas with Canadians now stationed in Kabul.

The governor general met with Afghan President Hamid Karzai and other senior Afghan officials to discuss Canada's contribution to Afghanistan, while MacKay met with US General John R. Allen, who is commanding the international military presence there.

"Canadian Forces members have worked tirelessly, at home and abroad, to save lives, provide security, and promote peace," MacKay said in a statement.

"It has been a busy, challenging year. As we celebrate the holidays, we should also take time to think of those who are still deployed throughout the world."

Liberal Leader Bob Rae also took part in the trip to Kabul, donning Santa hats with MacKay and Johnston for a photo with soldiers.

Canadians are carrying out their duties with the utmost professionalism and distinction, Rae said in a statement.

"Especially during the holiday season, we recognize and appreciate their continued hard work and sacrifice as they celebrate away from their loved ones," he said.

"All Canadians should be proud of the work they are doing, as we continue our efforts to bring peace, stability and hope to a troubled region of the world."

The trip to Afghanistan had become an annual Christmas ritual for MacKay and Canada's top soldiers, who in past years spent the time at the base in Kandahar that used to be home to over 2,500 Canadian troops.

This year, around 950 sliders are stationed in and around Kabul, providing classroom instruction to Afghan soldiers and police and trainers and also mentoring Afghan medical staff.

The training mission in Afghanistan, announced last year by the Harper government, got underway this past summer. Troops have arrived in the area in waves and serve an average of eight months in theatre.

Thus far, only one soldier has been killed as part of the mission, which the government initially described as "low risk."

Master Cpl. Byron Greff of the 3rd Battalion Princess Patricia's Canadian Light Infantry was killed when the vehicle he was riding in was struck by a powerful suicide car bomber on Oct. 29.

Taliban suicide bomber kills 7 Pakistani troops

A Taliban suicide bomber killed seven Frontier Corps soldiers today in an attack on a base in northwestern Pakistan. The attack, the second against the Frontier Corps in two days, was carried out to avenge a senior Taliban commander killed in a drone strike two months ago.

The Taliban suicide bomber rammed his explosive-laded car into a building at a Frontier Corps base in the settled district of Bannu and detonated the bomb, killing at least seven soldiers and wounding dozens more. Officials said the death toll may rise as several of the paramilitary soldiers may be trapped under the rubble.

A Taliban spokesman said the attack was designed to punish the Pakistani military for allowing the US to conduct an airstrike that killed a senior commander.

"We claim responsibility for the attack, which was launched to avenge the killing of one of our commanders Taj Gul in a US drone strike in South Waziristan tribal region last month," Ihsanullah Ihsan, a spokesman for the Movement of the Taliban in Pakistan told AFP. "Our attacks will continue against the security forces."

The attack is the second against the Frontier Corps in 24 hours. Yesterday, a platoon-sized Taliban assault team killed one Frontier Corps soldier and captured 15 more after overrunning a fort in the nearby district of Tank. That attack was led by Asmatullah Shaheen, or Asmatullah Bhittani, the Taliban's commander for Tank who is on the list of 20 most-wanted Taliban leaders.

The Taliban also claimed that the assault was executed to avenge the death of Taj Gul Mehsud, who has been described as the group's operations commander in South Waziristan and a senior deputy to Hakeemullah Mehsud, the leader of the Movement of the Taliban in Pakistan, which is based in Pakistan's tribal areas and the northwest.

Taj Gul was reported to have been killed along with 12 other fighters in a US airstrike on Oct. 26. His death was not confirmed until Asmattullah announced yesterday's attack against the Fronteir Corps. Taj Gul has been described as a senior deputy to Hakeemullah Mehsud, the leader of the Movement of the Taliban in Pakistan, which is based in Pakistan's tribal areas and the northwest.

Hakeemullah's forces are at war with the Pakistani state and also send troops to Afghanistan to fight NATO forces. He has vowed to carry out attacks in the US, and was behind the failed car bomb plot at Times Square in New York City on May 1, 2010.

Two of Hakeemullah's top deputies have recently signaled that their group is willing to make peace with the Pakistani state. While there is no official ceasefire between the Pakistani military and the Taliban, attacks against security forces and suicide attacks have been rare. The last reported suicide attack in Pakistan took place in late August. he Pakistani government has signaled it wishes to stop fighting the Taliban, and has suspended operations against the terror group, except for in the tribal agency of Arakzai.

A pause in drone strikes in Pakistan

The US has put the drone program, which hunts senior al Qaeda and Taliban leaders as well as dangerous operatives, on hold since the Nov. 26 clash with Pakistani forces in Mohmand that resulted in the deaths of 24 Pakistani troops. The last strike took place 36 days ago, on Nov. 16.

The current pause in strikes is the longest since the program was expanded in the summer of 2008. A US intelligence official told The Long War Journal that the program is "on hold" so as not to contribute to the deteriorating relations between the US and Pakistan. Officials said the pause would be broken only if a high-value target were identified, but would not say how senior the al Qaeda leader must be for another strike to occur.

Christmas first came to the country with the first Europeans in the 16th century, and only became popular in recent decades, as people from all over the world have come to Japan.

SYDNEY - Australian miner Gloucester Coal Ltd has agreed to be acquired by China's Yanzhou Coal Mining Co. Ltd. in a $2.13 billion deal, which will see further consolidation in the country's mining sector.

Gloucester Coal said its largest shareholder Singapore's Noble Group Ltd, which holds 64.5 per cent stake in the company, has given its consent to the deal.

"Noble has informed the independent directors of Gloucester that, subject to approval by the Noble board of directors and in the absence of a superior proposal, it intends to vote its shareholding in favour of the merger proposal," the company said in a statement.

Under the deal, Yancoal Australia Ltd., a wholly owned subsidiary of Yanzhou Coal, will acquire Gloucester in order to merge both companies' coal mines in New South Wales and Queensland. Yancoal will control 77 percent of the new company, while the remaining 23 percent will owned by Gloucester shareholders.

The deal will see China's Yancoal step up its long march into Australian coal deposits, having so far this year spent $19 billion in mining acquisition within the country this year.

In the consolidation spree engulfing the coal mining sector this year, there have been 10 separate deals involving more than a dozen coal deposits in Australia and overseas. Most of these deals are by Chinese and Indian companies seeking to secure supplies overseas to bridge shortages in coal supplies back home.

Yancoal is developing eight projects in Australia with the capacity to turn out 48 million tonnes a year. The Gloucester merger is Yancoal's third coal asset purchase this year.

In August, it bought the private Syntech Resources for $203 million and in September it acquired two Wesfarmers coal mines, Premier and Char, in a $297 million deal. The $2.13 billion deal for Gloucester will create the ninth-largest coal mining operation in the world.

Shareholders in Gloucester will retain 23 per cent of the new $6.5 billion company. Yancoal will be spun out of Yanzhou, but the Chinese parent company will remain a substantial investor in the Australian organisation that is likely to list on the Australian Securities Exchange next year.

Gloucester shareholders will have the option to receive either all ordinary shares in the merged company or a combination of ordinary shares and Contingent Value Rights (CVR) shares.

Spokesmen for Yancoal and Gloucester - along with sector analysts - could not confirm what proportion of the new listed shares would be liquid, given that the Chinese subsidiary would retain 77 per cent of the merged miner.

What sets this latest deal apart from others in the sector this year is that it will create an entity that remains on the stock market.

All other deals involving listed coal companies this year have led to them being taken off the boards. Those affected include Riversdale Resources, Coal Allied, Macarthur Coal, Hunnu Coal and - if a proposed merger with Whitehaven goes ahead - Aston Resources.

Verizon Wireless back online after nationwide data outage

Verizon customers across the country experienced data outages this week, but according to Verizon reps, the network has been fully restored.?

Verizon Wireless said it had fully restored data service after a widespread disruption to its 4G and 3G networks. Reps for the carrier did not specify the extent or the exact nature of the outage, which is the second to hit Verizon in the space of a month.?

"Verizon Wireless 4G LTE service is returning to normal this morning, after company engineers worked to resolve an issue with the 4G network during the early morning hours today," a Verizon rep told ZD Net in an emailed statement. "Throughout this time, 4G LTE customers were able to make voice calls and send and receive text messages. The 3G data network operated normally."?

According to the Washington Post, on December 7, Verizon experienced similar problems with its 4G network. As the number of smartphone users in the US soars network slowdowns or stoppages are becoming increasingly common. Earlier this year, Verizon introduced a?"network optimization" plan to help manage the number of heavy data consumers. (Essentially, it limits the bandwidth for the top 5 percent of users.)

Meanwhile, in October, Sprint nixed unlimited data plans for tablets and netbooks, while keeping in place unlimited data plans for smartphones. Sprint remains the only carrier in the country to offer unlimited smartphone data ? both?AT&T?and?Verizon, for instance, currently cap or throttle 3G and 4G data usage for new customers on all their devices.?

Paul, Bachmann spar over Iran and nuclear threat (AP)

SIOUX CITY, Iowa ? Republican presidential candidates Ron Paul and Michele Bachmann are trading barbs over Iran, with the Texas congressman saying the U.S. has no legitimate claim to block Tehran from developing a nuclear weapon and Bachmann calling his position wildly dangerous.

The two House members clashed during Thursday night's GOP debate while standing next to each other.

Paul says that terrorists want to harm the U.S. because it bombs innocent civilians and invades countries. The libertarian-leaning lawmaker says the worries over a nuclear Iran are merely the pretense for the U.S. to start another war.

Bachmann says that Iran is led by "an avowed madman" and committed to destroying Israel. She says Iran must be stopped.

Film details Jerry Lewis' 'Method to the Madness' (AP)

LOS ANGELES ? Gregg Barson is a documentarian, not a comedian. But when Jerry Lewis let him know that more than a dozen people were waiting in line to tell his story, Barson offered a persuasive punch line.

"Yeah, but they're not me," was Barson's comeback, followed by a momentary quiver of fear that he'd gone too far with the veteran star.

"He said, `I like that. You know why? Because you remind me of me,'" Barson recalled. That chutzpah-fueled exchange led to "Method to the Madness of Jerry Lewis," debuting 8 p.m. EST Saturday on Encore. Other airings include 11:30 a.m. EST Sunday and 8 p.m. EST Tuesday.

The film focuses on what makes the 85-year-old ? and still working ? Lewis tick as a performer and filmmaker. Those looking for dish on his family life or breakup with stage and screen partner Dean Martin or abrupt departure from the Muscular Dystrophy Association telethon he'd nurtured for nearly five decades won't find it here.

Barson, who describes himself as being "in heaven" whenever he caught a Lewis film on TV as a youngster, said his intent was to focus on Lewis' career from vaudeville on and his contributions to comedy and movies.

Younger people without exposure to Lewis' work likely consider him as "that telethon guy. Hopefully, the film will open their eyes as opposed to thinking he did one thing one day a year," Barson said.

During more than three years of filming, Barson had near-complete access as he followed Lewis from his yacht in San Diego to his home in Las Vegas to concert dates and to the Cannes Film Festival in France, the country that idolizes Lewis as a cinematic genius.

He was good company, Barson said. "He's always up, funny and playful. ... The sparkle, he didn't put in on for the camera. He's being real."

"Method to the Madness," which opens with Jerry Seinfeld, Eddie Murphy and other comedians anointing Lewis as comedy royalty, is an unabashed valentine. It is also a reminder that Lewis inspired rock-star levels of fan devotion, and of how impressively "The Bellboy" (1960) and many other films starring and written and directed by Lewis ruled the box office.

Barson, who made the well-received Phyllis Diller documentary "Goodnight, We Love You," sees parallels between Diller and Lewis, including their work ethic.

"She was 84 when she retired, and he's 85 and still working. They never rest on their laurels," Barson said. "They still care. They're not phoning it in."

And that, he said, is part of Lewis' method: Every aspect of his performance is planned.

"As Eddie Murphy says (in the film), slapstick looks simple but the reason it's been around so long is how well thought out it is," Barson said.

Lewis is pleased with the film. And his health is good, according to the filmmaker, who spills one appropriately quirky personal secret on his subject: "He drinks a lot of orange soda. Maybe that's the fountain of youth."

Canada on Monday became the first country to announce that it would withdraw from the Kyoto protocol on climate change. Did the promise of riches from the country's vast?tar sands reserves play a role?

Canada on Monday became the first country to announce it would withdraw from the Kyoto protocol on climate change, dealing a symbolic blow to the already troubled global treaty.

Environment Minister Peter Kent broke the news on his return from talks in Durban, where countries agreed to extend Kyoto for five years and hammer out a new deal forcing all big polluters for the first time to limit greenhouse gas emissions.

Canada, a major energy producer which critics complain is becoming a climate renegade, has long complained Kyoto is unworkable precisely because it excludes so many significant emitters.

"As we've said, Kyoto for Canada is in the past ... We are invoking our legal right to formally withdraw from Kyoto," Kent told reporters.

The right-of-center Conservative government of Prime Minister Stephen Harper, which has close ties to the energy sector, says Canada would be subject to penalties equivalent to C$14 billion ($13.6 billion) under the terms of the treaty for not cutting emissions by the required amount by 2012.

"To meet the targets under Kyoto for 2012 would be the equivalent of either removing every car truck, all-terrain vehicle, tractor, ambulance, police car and vehicle off every kind of Canadian road," said Kent.

Environmentalists quickly blasted Kent for his comments.

"It's a national disgrace. Prime Minister Harper just spat in the faces of people around the world for whom climate change is increasingly a life and death issue," said Graham Saul of Climate Action Network Canada.

Kent did not give details on when Ottawa would pull out of a treaty he said could not work. Canada kept quiet during the Durban talks so as not to be a distraction, he added.

"The writing on the wall for Kyoto has been recognized by even those countries which are engaging in a second commitment," he said. Kyoto's first phase was due to expire at the end of 2012 but has now been extended until 2017.

Kent said Canada would work toward a new global deal obliging all major nations to cut output of greenhouse gases?China?and India are not bound by Kyoto's current targets.

The Conservatives took power in 2006 and quickly made clear they would not stick to Canada's Kyoto commitments on the grounds it would cripple the economy and the energy sector.

The announcement will do little to help Canada's international reputation. Green groups awarded the country their Fossil of the Year award for its performance in Durban.

"Our government is abdicating its international responsibilities. It's like where the kid in school who knows he's going to fail the class, so he drops it before that happens," said Megan Leslie of the opposition New Democrats.

Canada is the largest supplier of oil and natural gas to the United States and is keen to boost output of crude from Alberta's oil sands, which requires large amounts of energy to extract.

The Canadian Association of Petroleum Producers (CAPP) said all major emitters had to agree to cuts so that Canada did not put itself at a disadvantage.

Canada's former Liberal government signed up to Kyoto, which dictated a cut in emissions to 6 percent below 1990 levels by 2012. By 2009 emissions were 17 percent above the 1990 levels, in part because of the expanding tar sands development.

Kent said the Liberals should not have signed up to a treaty they had no intention of respecting.

The Conservatives say emissions should fall by 17 percent of 2005 levels by 2020, a target that CAPP president David Collyer said would oblige the energy sector to make sacrifices.

"It's a stretch and we'd be kidding ourselves if we said it wasn't," he told Reuters.

Vatican university hosts unusual tattoo conference (AP)

VATICAN CITY ? A Vatican university has hosted an unusual conference on the role of tattoos in shaping identity through history.

"Into the Skin: Identity, symbols and history of permanent body marks" is the brainchild of a Christian arts association and Israel's ambassador to the Holy See, an unlikely expert in the field given Judaism's prohibition of tattooing and the painful, permanent role that tattooed serial numbers played during the Holocaust.

Ambassador Mordechay Lewy acknowledged the paradox Tuesday, saying the living memory of Auschwitz's blue death stamps added another layer to Jewish aversion to tattooing.

Yet Lewy is a respected academic in the field ? and a fierce critic of what he calls the "commercialization" of an important aspect of cultural history.

U.S. Jewish ire prompts Israel to scrap ads for expats (Reuters)

JERUSALEM (Reuters) ? Israel has cancelled government-sponsored television advertisements calling on expatriates to return, after some American Jews complained that the message denigrated their lifestyles.

The spots, aired on Israeli channels that are often viewed by emigrants, featured dramatized scenes of Jewish assimilation in gentile settings. In one, an Israeli couple looks dismayed to hear their grandchild mention celebrating Christmas abroad.

"I don't think I have ever seen a demonstration of Israeli contempt for American Jews as obvious as these ads," wrote influential U.S. blogger Jeffrey Goldberg, in sentiments echoed by several American Jewish groups that lodged complaints.

The United States has the largest Jewish community outside Israel, and religious assimilation there is common. Israel looks to American Jews for support, but some in the community chafe at Israel's rightist tilt and strains in its ties with Washington.

Prime Minister Benjamin Netanyahu ordered that the ads, produced by Israel's Immigration and Absorption Ministry, be yanked "immediately" upon hearing of the controversy they caused, his spokesman said on Saturday.

"The government of Israel is very attuned to the sensitivities of the American Jewish community," the spokesman, Mark Regev, said.

INDIANAPOLIS (AP) ? Peyton Manning could soon be throwing footballs to his teammates, the best news Colts fans have heard since this miserable season began.

While the Colts and the four-time league MVP are still trying to find out what the next part of his rehabilitation program entails, lifting weights and throwing balls are apparently going to be part of it.

"Throwing will be part of the next progression," Manning said Friday before heading back to the team's weight room. "I will be doing some throwing and I have been doing some throwing. But now we're going to ramp it up a little more."

Manning called the news encouraging and said he would like to practice or even play this season if he's cleared.

Vice chairman Bill Polian said he is pleased with Manning's progress

"It's great news that the fusion has healed," Polian said after speaking at the Big Ten Football Awards Gala. "It's on schedule, so we just keep going from here."

It was welcome news in a winless season that began with Manning underdoing his third neck surgery in 19 months back on Sept. 8. He has not practiced since having a single-level spinal fusion that doctors hope will not only alleviate pressure on a damaged nerve that had caused weakness in Manning's throwing arm but allow the 35-year-old quarterback to return to his perennial Pro Bowl status.

Indy (0-11) has kept Manning on the active roster all season with the hope that he may start throwing at practice before the Jan. 1 season-finale at Jacksonville. He just might.

On Thursday night, the team issued a statement from Dr. Robert Watkins who said the fusion had healed firmly enough for Manning to increase the intensity of his workouts.

Those at the team complex are still trying to figure out what Manning can do.

"I don't know. I really don't know," coach Jim Caldwell said when asked about Manning's rehab program. "I just know they've been pretty cautious with what they've allowed him to do. I just know he's not practicing today. I know that."

The Manning story was newsy on a busy day in Indianapolis, where the inaugural Big Ten football championship is being played Saturday night and basketball fans are celebrating the return of the Pacers and the resurgence of the Indiana Hoosiers (7-0).

Even before Manning walked into the room, his locker was surrounded by so many reporters that teammates started joking about the entourage. Some simply laughed. Pro Bowl defensive end Robert Mathis climbed a cameraman's unoccupied stool to get a view from above. One player asked whether President Obama was expected in the locker room and when another asked what was going on, Pro Bowl receiver Reggie Wayne quipped: "He's retiring."

Manning was not amused by the media horde, which had anticipated a medical update Wednesday.

"There is no schedule, there never has been. I think we have checkpoints here, and I don't know when the next one is," he said during a 12?-minute question-and-answer session. "But I hope they don't announce it, so y'all won't be here on decision day like Wednesday supposedly was.'

At times, Manning was self-deprecating.

At others, he brushed off questions by acknowledging he didn't have all the answers.

And yet he wanted to avoid adding to the speculation about the hottest topics in Indy sports ? do this week's results suggest he'll get back to 100 percent, will the Colts exercise a $28 million option to keep him in Indy, might he ponder retirement or would he have a problem if the Colts drafted Stanford's Andrew Luck or some other standout quarterback with the No. 1 pick?

Indy is the clear front-runner in the chase for the top pick and many people believe the Colts should take Luck as Manning's successor. Luck has attended the Manning Passing Academy as both a pupil and a counselor, and Luck's father, Oliver, and Manning's father, Archie, were teammates with the Houston Oilers in the 1980s.

Manning insists he can't answer those questions now and has called the speculation about Luck disrespectful to his teammates, who are still trying to win games.

"He (Bill Polian) and I have not had a conversation about the 2012 draft," Manning said, referring to the Colts' vice chairman. "Bill keeps the players informed on a lot of things, but I've never been informed about who we're going to draft and I think that would be inappropriate."

Polian said about Luck is premature, and that the topic of Luck has not come up in conversations with Manning.

"We haven't talked specifics," Polian said. "We don't know where we're headed specifically. There's a long way to go 'till April."

Still, Manning's slow recovery has touched off talk of the Colts' future and even his possible retirement. Polian said the plan for now is for Manning to be with the team in the future.

"We've had discussions about it," Polian said. "He knows what our plans are going forward. He understands what the situation is. We've got a lot of work to do to rebuild our team, and all of that is part and parcel of a larger plan. He's well aware of where we're going. I'm sure he's anxious to be part of it."

Now the latest results have again raised hopes of a return.

"This is a good sign," Manning said. "A lot of people have had fusions, and I know of some cases where it doesn't take, so it's comforting."

Indy's biggest problem this season has been the unsettled quarterback spot.

Manning, who had started all 227 regular-season and playoff games since being drafted No. 1 overall in 1998, hasn't played a down.

Kerry Collins, who was signed in August, started the first three games before a season-ending concussion. Curtis Painter got the next shot and played well initially, then threw eight interceptions and one touchdown in the last five games. The team has benched Painter in favor of Dan Orlovsky for Sunday's game at New England (8-3).

But regardless of who is starting this week or the rest of this season, Colts fans continue to focus on No. 18.

"It's nice to have the reins cut off a little bit and do things that are a little more normal. It's nice that we've done what we were supposed to do over the last three months and that it allows you to go into that next phase," Manning said.

"But I think a lot of the questions will answer themselves in the next three months," he added. "I have to put a lot of energy and time into my rehab."

SAO PAULO (AP) ? Brazilian authorities say a tractor-trailor has slammed into a bus carrying sugarcane cutters, killing at least 33 people and injuring 13 others.

A police spokesman says the truck driver lost control as he was rounding a corner and heading down a hill early Saturday near a town called Miracles in the northeastern state of Bahia. The truck was carrying a load of construction materials, which also slammed into the bus.

The driver of the truck survived and is in a local hospital. Some of the others injured are in grave condition.

The police official spoke on condition of anonymity, saying he was not authorized to provide details.

He says an investigation is ongoing.

Sandusky accuser, charity settle legal dispute (AP)

STATE COLLEGE, Pa. ? Lawyers for a young man described in a grand jury report as a victim of sexual abuse by former Penn State assistant coach Jerry Sandusky said Thursday they settled a legal action regarding a charity's assets.

Harrisburg attorneys Ben Andreozzi and Jeffrey Fritz said the settlement protected the claim their client plans to assert to the assets of The Second Mile, a nonprofit for at-risk children Sandusky founded in 1977.

"We intend to initiate a civil lawsuit seeking damages from the organizations and individuals responsible for the sexual assaults upon our clients," the lawyers said in a release. "However, our priority at this time is to support our clients, including Victim No. 4, who will be testifying against Mr. Sandusky at the preliminary hearing."

Sandusky, 67, has been charged with sexual abuse of eight boys over a 15-year period. His preliminary hearing on 40 criminal counts is scheduled for Dec. 13 at the Centre County Courthouse in Bellefonte.

Andreozzi and Fritz said that under terms of the settlement, The Second Mile has agreed to obtain court approval before transferring assets or closing and give their client the ability to weigh in before a judge regarding any distribution of assets.

The Second Mile released a statement calling the agreement a reiteration of its existing legal liabilities and saying it does not include a finding of liability.

The Second Mile said earlier this week that its donors should consider giving money to the Pennsylvania Coalition Against Rape, the latest sign that the charity may not be a going concern much longer. The Second Mile said its December programs would go on as scheduled, however.

Prosecutors said Sandusky found his alleged victims through The Second Mile, which is based in State College.

Also Thursday, state Rep. Ronald Waters, D-Philadelphia, asked the Pennsylvania Department of Welfare ? the agency that licenses programs dealing with youth and children ? to provide him with detailed information about The Second Mile's activities.

Penn State President Rodney Erickson said Thursday the school would conduct a wide-open search for a new football coach, following the dismissal of head coach Joe Paterno shortly after Sandusky was arrested. Paterno has not been charged with any crime, although two other high-ranking administrators, former athletic director Tim Curley and vice president Gary Schultz, have been charged with lying to a grand jury and failure to properly report suspected child abuse.

They have denied the allegations and await a preliminary hearing in Harrisburg Dec. 16.

Penn State's trustees held a four-minute meeting Friday to formally approve decisions made in the immediate aftermath of the arrests of Sandusky, Curley and Schultz. The board scheduled the meeting after criticism that the trustees violated the state open-meetings law by taking its initial votes behind closed doors last month.

Erickson said the university will donate $1.5 million in bowl proceeds to a pair of sex-crime advocacy organizations in the wake of shocking sex-abuse allegations levied against a once-revered assistant football coach.

He said Big Ten bowl revenue, which usually goes back to the athletic department, will go instead to the Pennsylvania Coalition Against Rape and the National Sexual Violence Resource Center.

"This presents an excellent opportunity for Penn State to raise the national visibility of this issue," Erickson said. "Our students and fans are focused on a cause to play for, to cheer for."

In addition on Thursday, Sandusky's lawyer said he has not discussed pleading guilty with his client and that the former coach continues to maintain he is innocent of the charges against him.

Joe Amendola said Sandusky has never considered a plea in his case and the topic of a guilty plea came up as a "what-if" question from a reporter about potential additional charges.

"My answer to the `what if' question was analogous to saying, if weather forecasters were predicting a blizzard next week, which they are not, I would have to at least consider the possibility of postponing my scheduled trip to Philadelphia," Amendola said in an email.

Authorities say the sex abuse allegations were not immediately brought to the attention of authorities even though investigators say high-level people at Penn State apparently knew about at least some of them.

School President Graham Spanier was ousted as a result.

Before his appearance on Season 14, his most impressive win came against UFC veteran Brian Foster up at 155 pounds. Brandao crushed Foster, who's got UFC wins over Matt Brown, Forrest Petz and Brock Larson, with a nasty uppercut.

Brandao will face Dennis Bermudez on Saturday night for the Season 14 featherweight title and a six-figure contract with the UFC.
